WASHINGTON A Van Buren County man's lawsuit seeking paternity of a young boy won't be heard by the Supreme Court.The court without comment declined to consider a lower court ruling that barred Michael Barnes Junior of Gobles from filing suit.
Barnes attempted to sue to make the state Supreme Court declare him the biological father. He's listed as the father on the child's birth certificate but the child was conceived when the mother was married to another man.
Under Michigan law, a husband is presumed to be the legal father if a baby is conceived during a marriage.
Barnes lived with his girlfriend and helped raise the child for more than four years until their relationship ended in 2003.
